WizzyBay terms of service
WizzyBay is a service from Dhugal (Doug) Dennison, director at MailNinja Limited
By signing up to WizzyBay, you are agreeing to the below terms:
- We are not affiliated or associated with MailWizz, we are providing a ‘hosted MailWizz service’
- We have a full extended MailWizz licence and are running WizzyBay as an ESP
- We will try to run the latest version of the MailWizz platform at all times, however there may be delays as we need to test the latest version to ensure it is stable
- Our responsibility lies with the hosting of the platform, we are not responsibile for the platform itself, including features and bugs. If you have any questions regarding the MailWizz platform, please refer to the MailWizz support docs, however you will not have access to their support team as you are using our extended licence
- We currently host WizzyBay on Digital Ocean and will increase capacity as needed, however if our platform host goes offline, we will try to get it back up within 4 working hours and we are NOT liable for any loss of data or earnings
- Our working our for support are Monday to Friday, 8am to 4pm, UK timezone, not including bank holidays

- We do not endorse spam. WizzyBay is not a spamming tool, it’s designed to allow senders with larger databases to save money. Only send emails to people who have opted in to receive your emails. If you do spam, we will automatically terminate your account and will not refund you any payments, even if you’ve just paid
- If you get a high complaint, unsubscribe or bounce rate we will automatically suspend your account and will not refund you any payments, even if you’ve just paid
- Payments are made monthly from signup, if you fail to make a payment, we will suspend your account until payment is received
- If you wish to cancel your account, please contact our team at support@wizzybay.com and we will manually terminate your account
- In doing so, we hold no responsibility for loss of data or analytics after termination

Our industry blocklist
- terrorism or violent extremism
- pornographic or sexually explicit content and sexual encounter sites or services, escort services mail-order bride/spouse finders, international marriage brokers, and other similar sites and services
- exploitation or negative reference to any specific gender, sexuality or race
- pharmaceutical products
- work-at-home scams, make money online schemes, and lead generation opportunities, lead generation opportunities, multi-level marketing and affiliate marketing
- gambling services or products
- credit repair and get out of debt opportunities
- list brokers or list rental services
- selling “likes” or followers for a social media platform
- cryptocurrencies, virtual currencies, and any digital assets related to an Initial Coin Offering counterfeit products or products that infringe the intellectual property rights of others including trademark, copyright, design or patent rights
- any other legal services we deem as offensive or go against our code of ethics, such as firearms and tobacco related products and services
Our content blocklist
- any email containing highly personal or medical information
- online trading, day trading tips, and stock market related content
- daily horoscope reports
- mortgages and loans
- nutritional, herbal, and vitamin supplements
- adult entertainment/novelty items
- online dating services and applications (dating sites or services with a sexual emphasis or sexually explicit content – including images depicting nudity – are not permitted)
- real estate
- services that support programmatically sending mail on behalf of third parties without creating or reviewing the content
- any automated content from a bot or AI system
Our fair usage policy
- WizzyBay unlimited plan operates under a Fair Use Policy in order to prevent potential abuse.
- To ensure we do not endorse spam or attract spammers, our FPU (Fair Use Policy) is as follows:
- We will monitor accounts, especially new ones to check:
- Is your bounce rate above average
- Is your complaint rate above average
- Is your unsubscribe rate above average
- Do you have lots of lists (this suggests spam)
- Are you exporting and importing contacts more than once a month (this suggests they are not subscribed to your emails and you are flipping data!)
- Are your imported contacts primarily from accounts such as Gmail, Yahoo, Outlook
- Are you sending from domains and addresses that are not related to your registered business (we do not accept affiliate marketers)
- Plus, we run checks automagically in the background to see:
- Are you regularly hosting more than 500k contacts
- Are you regularly sending more than 1m emails per month (for larger accounts we may contact you to increase your quota)
- We will monitor accounts, especially new ones to check:
Please note
- We have a blacklist in our admin area, which we use to catch known bad domains and email addresses
- We have a blocklist in our admin area, which scans your emails for offensive language and auto blocks them
